They had so many hits of such a large file it choked the server(s). That's "Denial of Service" and it's a crime. Then he allegedly wrote an article explaining what he did and how others could do it. That shows malicious intent or at the very least an awareness of what he was doing. He didn't help his case with that temper. We saw it here with his other post on BCM.No, being "hauled off" was not harsh. Regardless, I'm sure somewhere in his ISP agreement (contract) there was a stated limit. AOL has a 2mb limit per screenname. That's why my fleet site is on the Chavik name. I also believe AOL has measures to prevent exceeding that limit but I'm sure you could on ocassion and would get warned to remove the excess. Whether they had limits or not it's still in the contract and your responsibility not to break that contract. I think it was way out of line and he is rightfully being charged with a crime.Go read the now 4 page thread over at that forum from one of the above links.

It is part of a larger issue that we are now calling Information Protection. My company has made it the number one I/T priority.The other problem with this kid is that he is a kid. He's still at that age where he doesn't think that what he does has consequences, or that if he "feels" that he didn't do something wrong (or that the laws are stupid), then he shouldn't be held liable for his actions. I love it when they start tossing out free speech arguments and call for the ACLU.I wonder how many Napster files he downloaded.

I mean, look at his history: he threatened Derek with a posting on his site (whoop), he THEN causes intentional disruption to an ISP...I dunno, I think he should be punished. Honestly, I think it would be a shame if he had to do anything with jail time - too young for that. But, I think he needs to be banned from his computers for awhile on top of a good ass-whipping from his mother.MHO though.
